Commission approves €9 billion Spanish capacity mechanism for electricity supply
The European Commission approved a €9 billion capacity mechanism for Spain under EU State aid rules on 28 May 2026. The measure, notified by Spain, will operate for ten years beginning in May 2026 and aims to ensure sufficient capacity for electricity production, storage, and demand-side response. The mechanism is market-wide and open to all projects capable of being available during periods of scarcity, including generation, storage, and flexible consumption. The Spanish transmission system operator will manage selection through transparent, competitive auctions. The scheme aligns with Article 107(3)(c) TFEU and the Guidelines on State aid for climate, environmental protection and energy 2022 (CEEAG). The Commission determined the measure is proportionate and consistent with best practices for capacity mechanisms as laid out in the Clean Industrial State Aid Framework (CISAF). Commission approves €15 million French State aid for agricultural and aquaculture companies facing increased fuel prices
On 27 May 2026, the European Commission approved a €15 million French State aid scheme to support agricultural and aquaculture companies affected by higher non-road diesel fuel prices resulting from the Middle East crisis. The scheme, valid until 31 December 2026, is part of the Middle East Crisis Temporary State Aid Framework (METSAF) adopted on 29 April 2026. Aid will be provided as direct grants based on fuel purchased between 1 and 30 April 2026, covering up to 70% of additional costs. The measure was assessed under Article 107(3)(c) TFEU and the METSAF, with the Commission finding it necessary, appropriate, and proportionate to address increased costs without distorting competition. Council Regulation (EU) 2026/1181 suspends Common Customs Tariff duties for certain fertilisers
Council Regulation (EU) 2026/1181 of 22 May 2026 was published on 29 May 2026, suspending Common Customs Tariff duties under Article 56(2)(c) of Regulation (EU) No 952/2013 for imports of urea, ammonia, and certain nitrogen-based fertilisers, with quotas for one year. The suspension excludes products originating in or exported from the Russian Federation and Belarus. The measure aims to improve fertiliser market supply and diversify sources, considering geopolitical developments and high energy costs. The regulation is binding until 31 May 2027. Commission Implementing Regulation (EU) 2026/1116 lists products with critical raw materials recovery potential
Commission Implementing Regulation (EU) 2026/1116 of 26 May 2026, published on 27 May 2026, establishes a list of products, components, and waste streams with significant critical raw materials recovery potential under Regulation (EU) 2024/1252. The list guides Member States in their national programmes to increase circularity of critical raw materials.
