Reporting Obligations on Defense Offsets Agreements for Calendar Year 2025

The Bureau of Industry and Security (BIS) at the Department of Commerce announced that U.S. companies involved in defense articles or services sales to foreign entities must file annual reports documenting offsets agreements exceeding $5 million, and offsets transactions with credits over $250,000 for calendar year 2025. Reports are required in both hard copy and electronic form by June 15, 2026, sent to BIS’s Offsets Program Manager and designated email. Data will be compiled for the Secretary of Commerce’s annual offsets impact report to Congress; individual company data remains confidential unless authorized. Critical Position Pay Authority Approved for National Security Investment Workforce

President Donald J. Trump approved, via memorandum on May 29, 2026, the use of critical position pay authority for up to 400 positions supporting national security investment programs, with OPM and OMB overseeing allocations across executive agencies. Pay rates of up to $400,000 may be authorized for roles in investment, engineering, finance, and law, specifically to build U.S. capability in critical minerals, advanced materials, and supply chains. The objective is to attract highly qualified individuals to meet strategic national security and industrial resilience targets, with compliance and oversight requirements outlined for agency use.

FAA Airworthiness Directive for Airbus Canada BD-500 Series Fuel Feed Systems

The FAA issued an Airworthiness Directive effective July 1, 2026, superseding AD 2024-04-06 and requiring operators of Airbus Canada BD-500-1A10 and BD-500-1A11 aircraft to replace saddle clamps, inspect motive flow fuel-feed tubes, and perform corrective actions for mechanical wear damage. Actions address risks related to fuel imbalance and flight capability reduction, as outlined in Transport Canada AD CF-2025-24. Compliance affects 96 aircraft; required actions may be incorporated during regular maintenance. Reporting requirements are waived, and operators must adhere to approved procedures and timelines.

State Department Proposed Information Collection for Classified Arms Export/Import (Form DSP-85)

The Department of State issued a 60-day notice requesting public comments on revisions to Form DSP-85—which authorizes permanent/temporary export or import of classified defense articles and technical data under ITAR and the Arms Export Control Act. Estimated 280 respondents will have a 30-minute response time, totaling 140 burden hours. The public may submit feedback until July 27, 2026, to improve accuracy and efficiency. DoD Solicits Comments for DFARS Part 225 Foreign Acquisition Information Collection Extension

The Department of Defense seeks feedback on the proposed extension of information collection requirements for the Defense Federal Acquisition Regulation Supplement (DFARS) Part 225, covering foreign acquisition. With 39,221 annual respondents and 382,876 responses, DFARS clauses ensure compliance with the Buy American statute, trade agreements, reporting for contract performance outside the U.S., specialty metals, duty-free entry, and various certificates. Responses are used for balancing payment program reporting and regulatory compliance. Comments accepted until July 28, 2026.
