President Trump Signs Executive Order to End Birth Tourism

On August 6, 2026, President Donald J. Trump issued an executive order focused on curbing birth tourism, where foreign nationals enter the United States on nonimmigrant visas with the primary intent of giving birth and securing citizenship for their children. The order assigns the Secretaries of State and Homeland Security authority to refuse entry, visa issuance, or travel authorization to individuals suspected of engaging in birth tourism. According to the order, exemptions can be made for humanitarian reasons or national interest. The order stresses that birth tourism reduces the integrity of the immigration system, disrupts resource allocation, and could affect national security. Implementation instructions and compliance guidelines are enumerated in the order, which does not bestow any enforceable rights for or against the U.S. government.
