CEQ Guidance on Categorical Exclusions for NEPA Compliance
The Council on Environmental Quality released updated guidance for federal agencies on establishing, revising, adopting, and applying categorical exclusions (CEs) under the National Environmental Policy Act. The guidance incorporates amendments from the Fiscal Responsibility Act of 2023 and addresses repeal of prior NEPA regulations, focusing on efficient permitting for infrastructure projects while maintaining adherence to statutory requirements. New technology resources, including the Categorical Exclusion Explorer database and CE Works platform, have been introduced to digitize the application process. Federal agencies can use CEs to fulfill NEPA obligations for actions generally not expected to cause significant environmental effects, expediting reviews for certain construction activities.

HUD Notice for Comment on HOME Program Maximum Per-Unit Subsidy Limits
The Department of Housing and Urban Development published a notice seeking public comment on its updated methodology for determining maximum per-unit subsidy limits for the HOME Investment Partnerships Program. The notice sets the cap at 240 percent of the basic mortgage limits for Section 234 of the National Housing Act as applied to elevator-type condominium housing, reversing a proposal to increase the limit to 270 percent. The updated limits affect projects for which HOME funds are committed on or after May 11, 2026. Stakeholders are invited to comment on the practicality and appropriateness of the current approach, particularly in light of industry changes and rising construction costs.

Extension of Multi-Family Housing Simple Transfer Pilot Program
USDA’s Rural Housing Service extended the Simple Transfer Pilot Program for Section 514 Farm Labor Housing and Section 515 Rural Rental Housing properties until December 31, 2027. The pilot provides streamlined transfer options for eligible property transactions, reducing application requirements, costs, and processing times for less complex transfers. Three types of simple transfers remain available, including expedited cases for estate transitions and rehabilitation plans for nonprofit or government agency purchasers. The agency may consider permanent regulatory adoption of successful elements after evaluating pilot outcomes.

HUD Withdraws Multiple Fair Housing and Equal Opportunity Guidance Documents
HUD's Office of Fair Housing and Equal Opportunity announced the withdrawal of several guidance documents covering digital platform advertising, reasonable and service animals, source of income testing, credit programs, and use of criminal records under the Fair Housing Act. The withdrawal, effective since September 17, 2025, follows directives under Executive Orders 14192 and 14219 and aims to align agency guidance with statutory requirements and minimize compliance burdens. New guidance will be issued as needed, and the agency signaled flexibility in enforcement where entities acted in good faith under the earlier guidance.

ITC Rules on Steel Concrete Reinforcing Bar Imports
The International Trade Commission completed its second five-year review of countervailing and antidumping duty orders covering steel concrete reinforcing bar imports from Mexico and Turkey. The commission found that removing the existing orders would likely lead to a recurrence of material injury to the U.S. industry within a reasonably foreseeable time. The decision maintains duties on imports from these countries and concludes expedited reviews initiated in September 2025, as outlined in USITC Publication 5722.
